In most cases, yes.

“Pastoral counseling” and “Biblical counseling” are not typically regulated by the state.

It is a very fine line, however, between biblical/”pastoral” counseling and psychotherapy. Psychotherapy IS regulated by the state, and a pastor would be violating state law if he/she were to provide it without a proper license (e.g., , psychologist).

Is he literally calling it a counselling session ?
If he does then it is not legal.
People go to universities and get degrees for that stuff.
If however he wants to make you feel better and listen to your problems, like a normal friend would then it is fine.
